Terms & Conditions

I would like working together to be straightforward and enjoyable, so I've set out below how I work and the terms that apply to my design services.

These terms apply to all design work and services provided by Sandra Moyes. By accepting a quotation or cost estimate and confirming that you would like me to proceed with a project, you are agreeing to these terms and conditions.

Project progression and quotations

Once I have received a brief, I will provide a written quotation or cost estimate based on the information and requirements discussed.

Once you have accepted the quotation and confirmed that you would like me to proceed, I will begin work on the project.

My quotation is based on the agreed brief and scope of work. If the brief changes or additional work is requested during the project, I will let you know if this is likely to affect the cost. I will agree any additional costs with you before carrying out the extra work.

If the scope or cost of a project changes, the most recent quotation or written agreement will replace any previous quotation.

Payment

My standard payment terms are 30 days from the date of invoice, unless we have agreed different terms in writing.

If payment is not received within the agreed payment period, I reserve the right to charge interest and compensation in accordance with applicable UK late payment legislation.

If you have a query about an invoice, please contact me by email within 14 days of the invoice date so that I can resolve it with you promptly.

Supplying materials and information

Some projects rely on you providing information, copy, images, logos, artwork or other materials.

I will always do my best to work to the agreed timescales, but if I am waiting for information or materials from you, this may affect the project deadline. Any resulting delay will be taken into account when agreeing a revised delivery date.

You are responsible for ensuring that you have the necessary rights and permissions to use any materials you supply to me.

Copyright and ownership

Unless otherwise agreed in writing, copyright in original design work created by me remains with Sandra Moyes until all agreed fees for the work have been paid.

Once payment has been received in full, you will have the right to use the agreed final design work for the purpose and applications discussed as part of the project.

Unless specifically agreed otherwise, my working files and original source files remain my property. If you require editable or working files, this can be discussed and agreed as part of the quotation.

I may show completed work in my portfolio, website and social media to promote my services, unless you ask me not to or the project is confidential.

Where designs involve third-party images, fonts, illustrations, stock assets or other licensed material, their use will remain subject to the relevant third-party licence terms.

You are responsible for checking that any final design, wording, claims, trademarks or other content is suitable and legally compliant before it is published or produced. I will always take reasonable care in preparing your artwork, but I cannot accept responsibility for legal claims arising from content or materials supplied or approved by you.

Website design

Where I provide website design services, my role is primarily the creative design, structure, layout and presentation of the website.

Once a website design, template, structure or navigation has been approved, changes to the agreed structure, navigation or content may involve additional charges.

Where website hosting or technical services are provided through a third-party platform, such as Squarespace, those services are subject to the provider's own terms and conditions.

I cannot guarantee that a website will always be available or free from technical issues, interruptions or changes made by third-party platforms.

I am not responsible for the ongoing security, technical maintenance or performance of a website unless these services have been specifically agreed as part of my services.

Search engines and their algorithms are continually changing. While I can take SEO considerations into account where agreed as part of a website project, I cannot guarantee search engine rankings or ongoing search performance.

Cancellation

If you decide to cancel a project after accepting a quotation and I have already started work, you will be invoiced for the work completed up to the date of cancellation.

You will also be responsible for any costs that I have already committed to on your behalf in relation to the project, where these cannot reasonably be cancelled or refunded. This may include purchased images, freelancers, travel or other third-party services.

Limitation of liability

I take care and pride in the work I provide and will always aim to deliver work to a professional standard.

To the extent permitted by law, my total liability in relation to a project will be limited to the fees paid by you for that particular project.

Nothing in these terms limits or excludes liability where doing so would not be permitted by law.

Disclaimer

I will always take reasonable care when providing my design services and will work with you to achieve the agreed objectives of the project.

However, I cannot guarantee that the final design or website will achieve a particular commercial result, level of sales, search engine ranking or other outcome unless this has been specifically agreed in writing.

You are responsible for approving final artwork, content and information before it is published, printed or otherwise used.
